Resolution No. 2025-XX <br />Page 1 of 11 <br /> <br /> <br />RESOLUTION NO. 2025-XX <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF SANTA ANA APPROVING CONDITIONAL USE <br />PERMIT NO. 76-38-MOD-1, TO ALLOW THE EXPANSION OF <br />AN EXISTING SELF-STORAGE FACILITY AND TO REMOVE <br />THE PREVIOUS CONDITION OF APPROVAL REQUIRING <br />INTERNAL PERIMETER THREE -FOOT-WIDE LANDSCAPE <br />PLANTERS, AT 212-280 N. SULLIVAN AND 2602 W. FIFTH <br />STREETS (APNS: 007-141-78, 007-141-79, AND 007-141-11) <br /> <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br /> <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines, and declares as follows: <br /> <br />A. Extra Space Properties 103, LLC (“Applicant” and “Property Owner”), is <br />requesting approval of Conditional Use Permit (“CUP”) No. 76-38-MOD-1 to <br />modify the existing CUP to expand an existing mini-warehouse facility, <br />commonly referred to as self-storage, and revise the existing conditions of <br />approval at 212-280 N. Sullivan and 2602 W. Fifth streets (“Project”). <br /> <br />B. The Project’s site consists of three parcels, developed as self -storage facilities <br />over time. The 2602 W. Fifth Street parcel was developed circa 1974 with seven <br />one-story steel frame metal storage buildings through administrative approval, <br />without requiring a CUP. <br /> <br />C. On July 17, 1972, the Santa Ana City Council adopted Ordinance No. NS-1123, <br />requiring a Conditional Use Permit for commercial uses, including enclosed <br />storage, within the Light Industrial (M1) district. <br /> <br />D. On January 24, 1977, the Planning Commission approved CUP No. 76 -38 for <br />expansion of a self -storage facility at 280 N. Sullivan Street, authorizing <br />construction of several one-story buildings, office, and manager’s residence. <br />The City Council affirmed the approval on February 22, 1977. <br /> <br />E. On April 15, 2002, the City Council adopted Ordinance No. NS-2494, <br />establishing additional restrictions on certain uses, including new self-storage <br />facilities within proximity to arterial streets, freeways, and freeway intersections. <br />The Ordinance provides for case-by-case evaluation of the proposed uses, in <br />order to achieve greater consistency with the General Plan goal of promoting <br />land uses that enhance the City’s economic and fiscal viability while ensuring <br />that impacts of development are mitigated. <br /> <br />F. Pursuant to Section 41-472.5(p) of the Santa Ana Municipal Code (“SAMC”), a <br />CUP is required for self-storage uses provided that no conditional use permit <br />shall be granted unless a written finding is made that the parcel on which the <br />
