Department Head or authorized designee. <br />For example: <br />An employee working a Monday through Friday work schedule who takes nine (9) hours <br />of vacation leave on Monday and works their normal thirty-one (31) hours Tuesday <br />through Friday, would not earn overtime for two (2) hours they volunteered to work extra <br />on Saturday. However, if that same employee had been required by their supervisor or <br />management to work the two (2) hours on Saturday, as opposed to volunteering, the two <br />(2) hours would be compensated as overtime. <br />6.4 Compensation for Overtime <br />The City's preferred method by which overtime shall be compensated is by monetary <br />payment, at one and one-half (1.5) times the employee's regular rate of pay, subject to the <br />provisions of Section 6.5. <br />6.5 Compensatory Time <br />A. Overtime Conversion to Compensatory Time <br />Should the Department Head determine that the best interests of the City will be <br />served thereby, their designee may permit an employee to be compensated for <br />overtime work by earning compensatory time off at the rate of one and one-half <br />(1.5) hours for each overtime hour worked. <br />B. Maximum Accumulation of Compensator <br />Employees shall have the option, with Department Head approval, to earn up to a <br />maximum of eighty (80) hours of compensatory time off. <br />C. Use of Compensatory Time <br />1. Since compensatory time is earned at one and one-half (1.5) hours for each hour <br />of overtime worked, eighty (80) hours of compensatory time equates to fifty- <br />three point thirty-three (53.33) hours of overtime worked. <br />2. Such compensatory time off shall be taken at the discretion of the employee <br />when requested at least seventy-two (72) hours in advance, subject to the <br />operational needs and staffing requirements of the department. <br />3. If the Department Head or their designee subsequently denies the requested <br />compensatory time off, the employee and department will mutually agree on a <br />future date within one (1) year when the employee can use the paid <br />compensatory time off. <br />2025 MOU City of Santa Ana & SEIU Full -Time Employees Unit Page 32 <br />
