25. In the event any action is brought by any party against the other party for the <br /> enforcement or declaration of any right or remedy in or under this Agreement or for the breach of <br /> any covenant or condition, the prevailing party shall be entitled to recover, and the other party <br /> agrees to pay, all fees and costs to be fixed by the court therein including, but not limited to, <br /> attorneys' fees and costs. <br /> 26.
