1 65. KACHIRISKY also continued to serve as a ranking Board Member of the POA and in 2022 <br /> 2 <br /> was elected Vice President. <br /> 3 <br /> 4 66. In March of 2022,KACHIRISKY received a threatening letter via the United States Postal <br /> 5 Service at his home from"the silent majority"(i.e.,members of"the Valentin camp")urging KACHIRISKY <br /> 6 to "take a stand against Gerry Serrano" and falsely accusing KACHIRISKY of various activities. <br /> 7 <br /> KACHIRISKY reported this letter to both CITY and to the Glendora postal service. While CITY was <br /> 8 <br /> 9 required to investigate this issue within one year,to date,KACHIRISKY has received no further information <br /> 10 from CITY. <br /> 11 67. On August 26, 2022, Corporal Paul McClaskey located a "flyer" posted in the police <br /> 12 <br /> department's third floor west mens' bathroom entitled"Santa Ana Police Officers Association Widows& <br /> 13 <br /> 14 Orphans Fund 2022 Casino Fundraiser"which stated: <br /> 15 "Proceeds will help recover funds [KACHIRISKY] borrowed from the Widows &Orphans Fund. <br /> Funds will also go to: Gerry[Serrano's] personal legal fees[;] Gerry's bar tab[; and] the soon to be <br /> 16 bankrupt legal defense fund." <br /> 17 <br /> 68. Again, KACHIRISKY immediately reported this activity to his direct supervisor [Gil <br /> 18 <br /> 19 Hernandez] at CITY and Corporal McClaskey provided the flyer to the on-duty Watch Commander.Again, <br /> 20 CITY failed to comply with its mandated investigation duties. <br /> 21 69. On September 1,2021,the POA membership completed a"Vote of No Confidence" against <br /> 22 <br /> Chief Valentin with the majority voting that they had no confidence that he was capable of being the Chief <br /> 23 <br /> 24 of Police. Despite this, CITY responded - a mere 87 minutes afterwards - by posting a Memo on social <br /> 25 media with statements from Mayor Vicente Sarmiento and City Manager Kristine Ridge voicing their <br /> 26 support for Chief Valentin. Commander Enriquez then forwarded the Memo to all Department employees. <br /> 27 <br /> 70. The Sergeant eligibility list from the 2020 testing process remained valid from November <br /> 28 <br /> 2020 through November 2022. <br /> 17 <br /> KACAIRISKY v.
