In the aftermath of the External Panel interview and before the final results were released, <br /> 2 <br /> it came to light that Oscar Lizardi was a friend of the Garden Grove Lieutenant who sat on the external <br /> 3 <br /> 4 panel. Additionally, it also was learned that Lizardi had recently sat on a Sergeant's hiring panel at Garden <br /> 5 Grove Police Department and had specifically been asked by the Garden Grove command staff to treat one <br /> 6 of their own preferred candidates favorably. In other words, the Garden Grovel lieutenant"owed"Lizardi <br /> 7 <br /> a favor on this panel. <br /> 8 <br /> 9 104. Based on the information being circulated throughout the department, KACHIRISKY was <br /> 10 not hopeful of his chances to withstand such a corrupt process as he was aware that Chief Valentin was <br /> 11 extremely vindictive,particularly toward department members such as himself who were affiliated with"the <br /> 12 <br /> POA Camp". In other words, unlike the other candidates who only had to worry about their own <br /> 13 <br /> 14 performance, KACHHUSKY had to worry about specifically being targeted by Chief Valentin and those <br /> 15 acting on his behalf simply for being a perceived member of the "other" camp. <br /> 16 105. On March 15, 2023, the results were released and KACHIRISKY was informed he was <br /> 17 <br /> eliminated from the process after scoring a 61.67% on the external interview. This was in stark contrast to <br /> 18 <br /> 19 his scores in the mid-to-upper 80% range on the other components of the testing. <br /> 20 106. The rankings of the final eligibility list confirmed that the selection process was entirely <br /> 21 corrupt and tainted to the core. The top three candidates and their order was the exact same as had been <br /> 22 <br /> forecast by department members before the testing process even began: (1) Johanna Lizardi; (2) Travis <br /> 23 <br /> 24 Johnson;and(3)Luis Galleana.Moreover,all of the preferred SWAT members ranked well and will achieve <br /> 25 promotion. As members remarked throughout the department, the blatant corruption was now plainly"in <br /> 26 your face." <br /> 27 <br /> 107. Chief Valentin and those acting on his behalf were no longer making any effort to hide the <br /> 28 <br /> unlawful corruption,favoritism and discrimination even in a so-called"fair"civil service selection process. <br /> 27 <br /> KACAIRISKY v.
