1 FEDERAL RULE (I) - BYRD ANTI-LOBBYING AMENDMENT <br />1 <br />(I) <br />3 <br />certification. Each tier certifies to the tier above that it will not and has not used Federal appropriated funds to pay <br />any person or organization for influencing or attempting to influence an officer or employee of any agency, a <br />member of Congress, officer or employee of Congress, or an employee of a member of Congress in connection with <br />obtaining any Federal contract, grant or any other award covered by 31 U.S.C. 1352. Each tier must also disclose <br />any lobbying with non-Federal funds that takes place in connection with obtaining any Federal award. Such <br />disclosures are forwarded from tier to tier up to the non-Federal award. <br />Pursuant to Federal Rule (I) above, when federal funds are expended by REGION 4 ESC, the vendor certifies that <br />during the term and after the awarded term of an award for all contracts by REGION 4 ESC resulting from this <br />procurement process, the vendor certifies that it is in compliance with all applicable provisions of the Byrd Anti- <br />Lobbying Amendment (31 U.S.C. 1352). The undersigned further certifies that: <br />(1) No Federal appropriated funds have been paid or will be paid by or on behalf of the undersigned, to any person <br />for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or <br />employee of Congress, or an employee of a Member of Congress in connection with the awarding of a Federal <br />contract, the making of a Federal grant, the making of a Federal loan, the entering into a cooperative agreement, <br />and the extension, continuation, renewal, amendment, or modification of a Federal contract, grant, loan, or <br />cooperative agreement. <br />(2) If any funds other than Federal appropriated funds have been paid or will be paid to any person for influencing <br />or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of <br />Congress, or an employee of a Member of Congress in connection with this Federal contract, grant, loan, or <br />(3) The undersigned shall require that the language of this certification be included in the award documents for all <br />subawards at all tiers (including subcontracts, subgrants, and contracts under grants, loans, and cooperative <br />agreements) and that all subrecipients shall certify and disclose accordingly. <br />This certification is a material representation of fact upon which reliance was placed when this transaction was <br />made or entered into. Submission of this certificate is a prerequisite for making or entering into this transaction <br />imposed by Section 1352, title 31, U.S. Code. Any person who fails to file the required certification shall be subject <br />to a civil penalty of not less than $10,000 and not more than $100,000 for each such failure. <br />I certify compliance with this attribute. <br />1 FEDERAL RULE (J) - PROCUREMENT OF RECOVERED MATERIALS <br />1 <br />(J)When federal funds are expended by REGION 4 ESC, REGION 4 ESC and its contractors must comply with <br />4 <br />section 6002 of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act. The <br />requirements of Section 6002 include: (1) procuring only items designated in guidelines of the Environmental <br />Protection Agency (EPA) at 40 CFR part 247 that contain the highest percentage of recovered materials <br />practicable, consistent with maintaining a satisfactory level of competition, where the purchase price of the item <br />exceeds $10,000 or the value of the quantity acquired during the preceding fiscal year exceeded $10,000; (2) <br />procuring solid waste management services in a manner that maximizes energy and resource recovery; and (3) <br />establishing an affirmative procurement program for procurement of recovered materials identified in the EPA <br />guidelines. <br />Pursuant to Federal Rule (J) above, when federal funds are expended REGION 4 ESC, as required by the <br />this document, that the percentage of recovered materials content for EPA-designated items to be delivered or used <br />in the performance of the contract will be at least the amount required by the applicable contract specifications or <br />other contractual requirements. <br />I certify compliance with this attribute. <br />Page 26 of 34 pagesVendor: Sunbelt Rentals Inc24-15 Addendum 1 <br /> <br />
