1 FEDERAL RULE - FEDERAL RECORD RETENTION <br />1 <br />When federal funds are expended by REGION 4 ESC for any contract resulting from this procurement process, the <br />8 <br />grantees or subgrantees submit final expenditure reports or quarterly or annual financial reports, as applicable, and <br />all other pending matters are closed. <br />Vendor agrees that REGION 4 ESC, Inspector General, Department of Homeland Security, FEMA, the Comptroller <br />General of the United States, or any of their duly authorized representatives shall have access to any books, <br />documents, papers and records of Vendor, and its successors, transferees, assignees, and subcontractors that are <br />directly pertinent to the Contract for the purpose of making audits, examinations, excerpts, and transcriptions. The <br />relating to such documents. Vendor agrees to permit any of the foregoing parties to reproduce by any means <br />whatsoever or to copy excerpts and transcriptions as reasonably needed. Vendor agrees to provide the FEMA <br />Administrator or his authorized representative access to construction or other work sites pertaining to the work <br />being completed under the Contract. <br />I certify compliance with this attribute. <br />1 FEDERAL RULE - PROFIT NEGOTIATION <br />1 <br />For purchases using Federal funds in excess of $250,000, REGION 4 ESC may be required to negotiate profit as a <br />9 <br />separate element of the price. (See 2 CFR 200.324(b)). <br />When required by REGION 4 ESC, Vendor agrees to provide information relating to profitability of the given <br />transaction and itemize the profit margin as a separate element of the price. <br />I certify compliance with this attribute. <br />1 FEDERAL RULE - SOLID WASTE DISPOSAL ACT <br />2 <br />A non-Federal entity that is a state agency or agency of a political subdivision of a state and its contractors must <br />0 <br />comply with section 6002 of the Sold Waste Disposal Act, as amended by the Resource Conservation and Recovery <br />Act. The requirements of Section 6002 include procuring only items designated in guidelines of the Environmental <br />Protection Agency (EPA) at 40 CFR Part 247 that contain the highest percentage of recovered materials <br />practicable, consistent with maintaining a satisfactory level of competition, where the purchase price of the item <br />exceeds $10,000 or the value of the quantity acquired during the preceding fiscal year exceed $10,000; procuring <br />sold waste management services in a manner that maximizes energy and resource recovery; and establishing an <br />affirmative procurement program for procurement of recovered materials identified in the EPA guidelines. (78 FR <br />78608, Dec. 26, 2013, as amended at 79 FR 75885, Dec. 19, 2014.) <br />Pursuant to this federal rule, when federal funds are expended by REGION 4 ESC, the vendor certifies that during <br />the term of all contracts resulting from this procurement process, the vendor agrees to comply with all applicable <br />requirements as referenced in this paragraph. <br />I certify compliance with this attribute. <br />1 APPLICABLITY TO SUBCONTRACTORS <br />2 <br />Vendoragreesthatallcontractsitawardspursuanttoshallbeboundbythetermsand <br />1 <br />conditions of this procurement action. <br />I certify compliance with this attribute. <br />1 COMPLIANCE WITH THE ENERGY POLICY AND CONSERVATION ACT <br />2 <br />When REGION 4 ESC expends federal funds for any contract resulting from this procurement process, Vendor <br />2 <br />certifies that it will comply with the mandatory standards and policies relating to energy efficiency which are <br />contained in the state energy conservation plan issued in compliance with the Energy Policy and Conservation Act <br />(42 U.S.C. 6321 et seq.; 49 C.F.R.
