I F. CITY,via its MET Officers, Continued to Act Unlawfully. <br /> 2 <br /> 34. On August 9, 2020, five other CITY MET police officers (Dorin Buchanan, Mark Campi, <br /> 3 <br /> 4 then-Sergeant Oscar Lizardi,Jonathan McKee,Jonathon Perez)who- as referenced above had been hand- <br /> s picked for this assignment by Officer Rodriguez with Chief Valentin's blessing-were accused of verbally <br /> 6 harassing two teenage girls and of sexually-assaulting one at the Culichi Town restaurant in Santa Ana("the <br /> 7 <br /> Culichi Town Incident"). <br /> 8 <br /> 9 35. The girls' family (who had been told by the officers that they were CITY police officers) <br /> 10 and/or others repeatedly called 911 to report the Culichi Town Incident. <br /> 11 36. The MET members reportedly fled prior to patrol officers arriving. <br /> 12 <br /> 37. The MET members also reportedly coordinated with officer Andres Gil to tell officers at the <br /> 13 <br /> 14 scene that they should not take the mandated police report. <br /> 15 38. Thus, in violation of federal law, state law and CITY policy, no police report was taken. <br /> 16 39. Officer Gil was eventually rewarded with a transfer to MET. <br /> 17 <br /> G. Almost Immediately, MENENDEZ was Informed of the Culichi Town Incident and <br /> 18 <br /> 19 Reported Same to CITY. <br /> 20 40. On August 9, 2020, MENENDEZ received a phone call at approximately 0230 hours from <br /> 21 a witness to the Culichi Town Incident. <br /> 22 <br /> 41. Upon arriving at work,MENENDEZ looked for the police report so that he could direct the <br /> 23 <br /> 24 witness to the handling detectives/officers. <br /> 25 42. MENENDEZ then learned that,as referenced above,the responding officers had failed to file <br /> 26 the requisite police report. <br /> 27 <br /> 43. However, as several 911 calls had been made, an incident number (200805316) - and a <br /> 28 <br /> related Incident Detail Report -had been generated. <br /> s <br /> MENENDEZ V.
