1 69. MENENDEZ and other patrol officers were sent to assist with the crowd and with shutting <br /> 2 <br /> down/closing off all streets to vehicle traffic. <br /> 3 <br /> 4 70. As MENENDEZ stood monitoring the crowd at the corner of 3rd and Broadway Street, he <br /> 5 and the other officers could see off duty Officer Rodriguez, walking around, potentially intoxicated. <br /> 6 71. (It was later learned that,while at Copper Door Bar, Officer Rodriguez became involved in <br /> 7 <br /> a verbal fight with his wife and in a fist fight with other individuals in a parking lot behind the bar.) <br /> 8 <br /> 9 72. At this time, Santa Ana Council Member Jonathan Hernandez witnessed Officer Rodriguez <br /> 10 (who Council Member Hernandez recognized to be a CITY officer) and another man holding a struggling <br /> 11 woman in a parking lot in downtown Santa Ana, groping her breasts and telling her"chill,"and"shut up". <br /> 12 <br /> 73. Council Member Hernandez called Chief Valentin and reported the incident directly to him. <br /> 13 <br /> 14 74. Chief Valentin allegedly first responded by stating that the officer was retired but, when <br /> 15 Council Member Hernandez responded that he knew for a fact that the officer was not retired,Chief Valentin <br /> 16 then changed his answer to say that the detective was retiring soon. <br /> 17 <br /> 75. Officer Rodriguez fled prior to being contacted by any on-duty personnel. <br /> 18 <br /> 19 K. The Public Records Act Request. <br /> 20 76. Following this incident, Council Member Hernandez's friend, investigative journalist <br /> 21 Camacho, submitted a Public Records Act ("PRA") request for the names, photos and assignment of all <br /> 22 <br /> CITY sworn Police Department personnel. <br /> 23 <br /> 24 77. Many in the Police Department-unaware at the time of the reasoning behind this request- <br /> 25 were upset about their information being released and saw it as an officer safety issue. <br /> 26 78. There was a back and forth for about six weeks as the POA and its attorney Corey Glave <br /> 27 <br /> attempted to intervene on the officers' behalf in Court. <br /> 28 <br /> 14 <br /> MENENDEZ V.
