CITY OF SANTA ANA <br /> <br /> <br /> <br /> <br /> <br />The Developer shall: <br />(1) Be an independent developer capable of providing experienced, knowledgeable and <br />professional staff. <br />(2) Be responsive and maintain excellent working relationships with City residents, businesses, <br />government officials and City staff. <br />(3) Provide adequate staffing levels at all times and adhere to established schedules. <br />(4) Be knowledgeable of and comply with federal, state and local laws, including the Santa Ana <br />Municipal Code, as it applies to their proposal. <br />(5) Assume responsibility for all aspects of the development, and for ensuring that the project is <br />developed and operated in accordance with applicable state and federal laws. <br />(6) Shall ensure that the project is developed and operated in accordance with the City laws, <br />regulations, and planning and development process. <br />I. General Information <br />(1) Following the RFP Process and conditional on meeting other requirements and conditions, a <br />pre-loan commitment letter may be drafted by the Housing Division, reviewed and approved <br />by the Housing Division Manager, the City Attorney’s Office, and the Executive Director of <br />Community Development, before being recommended for approval by the City Council. The <br />letter shall state the maximum amount of program funds reserved for the project and list all of <br />the additional conditions, documents and steps that must be taken by the Developer prior to <br />loan closing. <br />(2) When determined appropriate, the City will provide information in its possession relevant to <br />preparation of required information in the RFP. The City will provide only the staff assistance <br />and documentation specifically referred to herein. <br />(3) The Developer shall be responsible for retaining data, records and documentation for the <br />preparation of the required information. These materials shall be made available to t he City <br />as requested by the City. <br />(4) This RFP does not commit the City to pay costs incurred in preparation of a response to this <br />RFP. All costs incurred in the preparation of the proposal, the submission of additional <br />information and/or any aspect of a proposal prior to award of a written contract will be borne <br />by the respondent. The City reserves the right to accept or reject the combined or separate <br />components of any proposal in part or in its entirety or to waive any informality or technical <br />defect in the proposal. <br />(5) All data, documents and other products used, developed or produced during response <br />preparation to the RFP will become property of the City. All responses to the RFP shall <br />become property of the City. The City will make best efforts to maintain Proposer information <br />EXHIBIT I <br /> <br /> SCOPE OF SERVICES <br />EXHIBIT 1
