Contracts over $10,000 must <br />comply with Equal Opportunity Affirmative Action requirements of Section 3 of the Housing and Urban <br />Development Act of 1968. Contractors and <br />subcontractors must comply with regulations issued under this Act and pertaining to labor standards <br />and HUD Handbook 1344.1. These provisions apply whether HOME funds are used for construction <br />or non-construction costs. <br /> <br />Lead-based Paint: Housing assisted with HOME funds constitutes HUD-associated housing for the <br />purpose of the Lead-Based Paint Poisoning Prevention Act and the Lead Safe Housing Rule, and is <br />therefore subject to 24 CFR Part 35. Unless otherwise provided, borrowers are responsible for testing <br />and abatement. <br /> <br />Build America, Buy America (BABA): Projects that receive HOME funding must comply with the <br />requirements of the Build America, Buy America Act, 41 USC 8301 et. seq., and all applicabl e rules <br />and notices, as may be amended, if applicable. Pursuant to HUD’s Notice, “Public Interest Phased <br />Implementation Waiver for FY 2022 and 2023 of Build America, Buy America Provisions as Applied <br />to Recipients of HUD Federal Financial Assistance” (88 FR 17001), any funds obligated by HUD on <br />or after the applicable listed effective dates, which will likely include a portion of the HOME funding <br />awarded under this NOFA, are subject to BABA requirements, unless excepted by a waiver.
