If any golf cart is damaged and/or rendered a total loss through the negligence or willful <br /> misconduct of Contractor, its agents, employees, subcontractors, or its assigns, then <br /> Contractor shall be responsible for 100% of the repair costs (parts and labor) or <br /> replacement costs for any such golf cart. <br /> h) Special Events. Contractor shall use reasonable efforts to obtain and maintain appropriate <br /> exposure for and usage of the Golf Course, including without limitation, as appropriate, <br /> conducting golf tournaments, clinics, exhibitions and other special events. Contractor will <br /> hold a minimum of three (3) community events annually provided at no cost to the public. <br /> i) Technology Systems. Contractor, as a Direct Cost, shall procure and maintain telephones, <br /> wiring, computers, software, data circuits, voice circuits, Internet circuits, security <br /> cameras, and all equipment necessary and appropriate to operate and support telephone <br /> communications to and within the Golf Course, automated tee sheet and starter functions, <br /> Point-of-Sale for all Pro Shop operations, Social Media and a website which provides <br /> public; on-line access to golf reservations. Contractor shall use such systems to market, <br /> record all Golf Course and Pro Shop, retain customer and sales transaction data and <br /> produce all documents and reports necessary to effectively operate the Golf Course and <br /> comply with CITY's reporting and auditing requirements.Technology systems shall satisfy <br /> CITY's and other government requirements for security and internal controls, including but <br /> not limited to, security of credit card and other customer data. <br /> j} Security of Data. Contractor shall notify CITY immediately upon any known or suspected <br /> loss,theft or disclosure of CITY data, including but not limited to loss of customer personal <br /> or credit data. <br /> k) Golf Course Manual. Contractor shall establish and maintain a Golf Course Manual that <br /> establishes expectations, uniform rules, procedures and operating policies for the City's <br /> Municipal Golf Course and Facility. The Golf Course Manual will establish requirements <br /> for the maintenance of the Golf Course in alignment with City standards. The Contractor <br /> shall operate the golf operations in accordance with the requirements of the Golf Course <br /> Manual. The Contractor shall maintain the Golf Course in accordance with the <br /> requirements of the Maintenance Standards and other requirements outlined in the Golf <br /> Course Manual. Contractor shall submit to the City on an annual basis at least sixty (60) <br /> days in advance of each Operating Year an updated Golf Course Manual (except for the <br /> first Operating Year for which the initial Golf Course Manual shall be submitted thirty(30) <br /> days prior to the Commencement Date). The initial Golf Course Manual and all subsequent <br /> Golf Course Manuals shall be subject to City's final approval. <br />
