He said the subject moved his hand and lie <br />was able to see the bottom portion of the phone, but he was not sure if he was talking to someone. <br />Officer Shiflett said 10 to 20 seconds later the door to the truck opened and the driver stepped orit. He <br />said the subject appeared to be hiu'iched over. Officer Shifflett said he was able to see the gun in his left <br />hand as he started to come up towards the officers that were behind him lie started to raise the gun up <br />and at this time he engaged the subject. Officer Shifflet fired 4 to 5 rounds until the subject fell to the <br />ground and he no longer had the gun in his hand pointing towards his partners.
