Santa Ana PD 2015-06456: Supplemental Report by #2564 Page 3 of 3 <br />Officer Tolosa said they built a bullet proof shield and they approached the police vehicles. Officer <br />Tolosa said the officers were given commands to the individual to drop the weapon. Officer Tolosa <br />said the door opened and the individual came out with the weapon in his hand and began shifting his <br />body towards the officers. <br />Investigator Frazier asked Officer Tolosa to give as much detail as he could regarding the incident. <br />Officer Tolosa said as he is positioned behind the units he was able to see the individual with the gun. <br />He said as the individual turned towards the officer's gun shots took place. Officer Tolosa said the <br />officers shot the individual when he turned towards them holding the gun he was not dropping as he is <br />being told to do so. Officer Tolosa said the officers told the individual to drop the gun and to come out <br />with his hands up in the air. <br />Officer Tolosa said after the individual was shot they moved up with the shield and they rendered aid. <br />He said the individual still had the gun in his hands as they approached and he remembers someone <br />kicking the gun from his hand. Officer Tolosa said he remained at the scene until he was relieved. <br />Officer Tolosa said he was the person who handcuffed the individual and also rendered aid. At this <br />time the medics were coming up and he assisted with cutting his clothes. He also observed that he had <br />several gun shots, a shot to his elbow with the fragment, a hole on his upper right chest, a shot to his <br />abdomen and a shot underneath his chin area. <br />Officer Tolosa described the weapon as a Smith and Wesson that was underneath the vehicle near the <br />tire. He said this was not a police weapon and he remained on scene because he believed the weapon <br />was loaded. <br />OCDA Investigator Frazier asked Officer Tolosa if he heard any shots coming from the vehicle. He said <br />prior to their arrival they heard via the radio that a shot had been fired, but it was not an officer involved <br />shooting. Officer Tolosa said he could see that his face was covered in blood. <br />Officer Tolosa said the individual was not responding to the officer's commands. He said several <br />o-fficers were yelling to the individaal to drop the gun. He said the officers were there prior to him and <br />they had knowledge that a weapon was involved. He said the individual did not follow the commands <br />and he exited the vehicle with the weapon in his hand. <br />Officer Tolosa stated he did not discharge his own handgun.
