McShane <br />and I interviewed witness egarding his observations during the OIS. Our interview <br />with took place in a Santa Ana PD interview room. The interview was audio recorded by <br />Investigator McShane. The following is a srunmary of orir conversation with Fernando. <br /> was driving northbound on Main Street in his white Toyota pickup truck. He was the only <br />occupant of his vehicle. observed several police cars attempting to stop a white Toyota <br />Tacoma pickup that was traveling northbound on Main Street three cars in front of <br />said the driver of the white Toyota Pickup yielded to the police cars and stopped. said the two <br />vehicles in front of him were able to negotiate traffic and leave the area. however, had to pull <br />the right and stop for the police activity in front of him. <br /> exited his vehicle and stood in the parking lot on the north/east corner of Chestnut and Main. <br />He estimated he was 50 feet from the white Toyota Tacoma the police had stopped. aid there <br />was one sole occupant of the Tacoma, who was later identified as Benito Osorio. From his position, <br /> began filming the incident with his cell phone. <br /> listened to police as they repeatedly yelled at Osorio, "Don't do it" and "Drop the gun." <br /> said Osorio was not listening to the commands made by the police. At one point <br />heard- an apparent gunshot-from inside of the Tacoma-and believed Osorio had shot himself. <br />watched as Osorio appeared to slump forward, then back into his seated position. Officers continued <br />yelling at Osorio to "Drop the gun" and "Don't do it." Officers started to approach the vehicle, but one <br />officer yelled that Osorio was still moving. <br />At one point after Osorio shot himself, he exited his vehicle. heard said he heard a second shot <br />and believed it was Osorio shooting at the police. heard police respond with gunfire, shooting <br />Osorio. believed he heard police shoot 6-7 times. Osorio fell to the ground at which point <br />police approached and provided first aid until paramedics arrived. <br />We concluded our interview with He wanted to say that he was concerned for the officers at <br />the scene. He believed police made every attempt NOT to shoot Osorio, but based on the fact Osorio <br />was not complying with police commands, they had little choice. added that the officers were <br />"very professional" and "did the right thing." provided us with consent to download the video <br />he made for the purposes of our investigation.
