And other people may have said a <br />couple things here and there but the one thing that remains constant was <br />that from Officer GARCIA giving the commands both in English and <br />Spanish. So yes, it is best practice for us to delegate one person to give <br />those commands as to benefit the person we are contacting. <br />SMITH: Do you speak Spanish, sir? <br />ENRIQUEZ: Yes I do. <br />SMITH: Okay. So you understood when he was giving those commands in <br />Spanish as well? <br />ENRIQUEZ: Absolutely. <br />SMITH: Okay. When he, the suspect, turned facing west to now facing south <br />towards you…and the other officers…and you decided to fire two rounds <br />at him initially, why did you do that? <br />ENRIQUEZ: (CLEARS THROAT). The suspect became a threat to us immediately. <br />Coming out with the handgun, giving lots of commands, him still holding <br />the gun at, as what I describe as a positon of advantage, presented and <br />holdin’ it close to his chest, turning and facing us put us in a very <br />vulnerable spot, it gave him the advantage. Uh…I was concerned about <br />the people in the area, the safety of them. It was the middle of the day, <br />uh, there’s two schools nearby, one in the northeast direction a quarter <br />mile away, and high school a quarter mile west of…lots of foot traffic. I
