But you do recall seeing it through the mirror that he was armed <br />with a gun? <br />GARCIA: Yes. <br />SMITH: <br /> <br />GARCIA: <br />SMITH: ***. ? <br />GARCIA: Yes. <br />SMITH: Uh… (PAUSE) gunshot I think you said, and if you <br />can describe it for me, the suspect wiping the blood off of his face and <br />then I think you said he grabbed a phone, can you take me through that <br />one more time? <br />GARCIA: Yeah, uh, I’m looking through the driver side, inside and stepping on my <br />doorframe. <br />SMITH: Uh-huh. <br />GARCIA: *** and I see he’s holding the gun with his left hand and he has his cell <br />phone in his right hand. Uh, he puts the gun down and wipes his face, uh, <br />wiping the blood off his face and then brings the phone to his ear, and I <br />believe I screamed out he’s got a cell phone, he’s got a cell phone.
