Uh, once he came out of the car I think there were several, uh, <br />drop the gun, drop the gun from several officers, uh… <br />SMITH: How about… <br />SHIFFLETT: …but… <br />SMITH: …you did you make any…I’m sorry go ahead. <br />SHIFFLETT: I don’t remember if I, if I shouted to drop the gun or not. <br />SMITH: Okay. <br />SHIFFLETT: Um…he, uh, it was just, just a couple seconds of after him stepping out to <br />where he started pointing it at or raising it up to point at the other <br />officers. I don’t even know if I was *** that a chance to say anything. <br />SMITH: Okay. So when he stepped out at, at what point were you able to identify <br />that he was armed with a weapon? <br />SHIFFLETT: As soon as he had both feet on the ground I could see he had the gun in <br />his hand? <br />SMITH: Do you remember what hand it was in at that time? <br />SHIFFLETT: The left hand. <br />SMITH: Left hand. So if he’s getting out and he’s facing somewhat catty-corner <br />and from your position his right side would have been more exposed to <br />you... <br />SHIFFLETT: Yes, sir. <br />SMITH: …and if he has the gun in his left hand, how is that visible to you?
