So you were able to identify that it was a phone and not the gun at <br />that time? <br />SWEET: Yes, he was, uh, *** like talking on it. <br />SMITH: Okay. Did you see the gun at that point, uh… <br />SWEET: No. <br />SMITH: …when you guy’s had made that approach? You didn’t have any view of it <br />at that time? <br />SWEET: Did not. <br />SMITH: Uh, was the passenger…either of the passenger windows either front <br />door, back, uh, door to the vehicle o-, are they open at all or were they <br />both closed? <br />SWEET: I believe they’re both closed. <br />SMITH: Could you hear any of his conversation? <br />SWEET: No. <br />SMITH: Or just that he was having a conversation? <br />SWEET: No just that, uh, he looked with his mouth moving like he was talking to <br />someone. <br />SMITH: Okay. And he had the cell phone in his right hand or left hand? <br />SWEET: Right hand. <br />SMITH: Up to his head and talking? <br />SWEET: Yes.
