SA 15-005 <br />ROSA began screaming into the phone for “BENNY” to answer her; however, neither he nor <br />anyone else did. <br />Anticipating that something was occurring at BENITO’S place of employment, involving <br />BENITO; ROSA immediately responded to his workplace in the city of Irvine, to further <br />investigate. At the location, ROSA learned that BENITO was not there. ROSA contacted <br />BENITO’S boss, HAROLD who told her that BENITO had left the location earlier in the day <br />indicating that he was heading home to have lunch with her. ROSA was confused and unsure of <br />what was going on with BENITO at that time. ROSA was unable to determine what BENITO was <br />referring to when he told her that he was in trouble. She could not figure out why or what had <br />taken place that would have caused him to be in trouble. <br />Detective ELMS advised ROSA that BENITO had been involved in a shooting incident <br />earlier in the day. It was alleged that BENITO had shot at another person and as a result of the <br />police contact, which occurred immediately after the shooting, that BENITO had shot himself <br />and at the police which resulted in his death. <br />ROSA was asked if she knew anyone by the name of ALBERTO MENDOZA HERNANDEZ, <br />the victim that BENITO had shot at prior to the police contact, and she said, “No.” ELMS asked <br />ROSA if she knew anyone by the name of JANET, and she said yes. ROSA had found that name <br />on BENITO’S cellular telephone approximately five years ago. At the time, ROSA confronted <br />BENITO with the name. Although BENITO denied having an affair with JANET, he told her that <br />his relationship with JANET was over and ROSA said that was the end of it.
