<br /><i: <br />Q <br />p.-J'l <br />,.(. <br />~? <br />c.J ~ <br />'~j <br />~vl <br /><.) <br /> <br />A-2010-099 <br /> <br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTil INSURANCE EXPIRES <br />4 - "2 - 26 \ \ <br />CLERK OF COUNCIL <br />DATE: ~ - 2- 3 -L 0 THIRD AMENDMENT TO AGREEMENT <br />'1L--" <br /> <br />THIS THIRD AMENDMENT TO AGREEMENT is entered into on July l , <br />2010, between MASTER LANDSCAPE & MAINTENANCE, INC., a California <br />corporation (hereinafter "Contractor") and the City of Santa Ana, a charter city and <br />municipal corporation organized and existing under the Constitution and laws of the State <br />of California (hereinafter "City"). <br /> <br />RECITALS: <br /> <br />A. The parties entered into Agreement A-2007-140 dated June 18,2007, hereinafter <br />referred to as "said Agreement" by which Consultant provides park landscape <br />maintenance services. <br /> <br />B. Said Agreement was twice amended by the parties. <br /> <br />C. In accordance with the terms and conditions of said Agreement, the parties wish to <br />again amend said Agreement to extend the term and modify the specifications for <br />maintenance of the City Parks. <br /> <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Second Amendment to Agreement, the parties agree as follows: <br /> <br />1. The SCOPE OF SERVICES, shall be amended to add a new Agronomics Plan <br />attached hereto as Attachment NO. 1 to this Amendment. <br /> <br />2. SCOPE of SERVICES Subsection C. Routine Maintenance, 1. Turf Care, i) (2) shall <br />be amended to read: <br /> <br />(2) Once per month the contractor shall overseed all sport/priority turf areas <br />with materials as directed by City Staf(at a rate of one (1) pound per 1,000 <br />square feet by mowing the existing turf down to !f.s" followed by verticutting <br />(straight blades) to remove thatch. <br /> <br />3. The following duties shall be added to the Contractor's duties under the Scope of <br />Work: <br /> <br />A. Replanting - Plant Material <br />The Contractor shall plant each year, in any area determined by the Director, 64 count <br />flats of2" plugs of plant species at appropriate spacing so as to achieve complete <br />coverage once the plant is 2/3rds mature. The Contractor shall be responsible for the <br />complete removal and replacement of plants lost due to normal attrition or due to <br />Contractor's failure to perform under the terms of this is Agreement City is <br />responsible for cost of replacing plants lost to vandalism; however Contractor must <br />prove that it was vandalism that killed the plant. See Attachment 7 for plant cap. <br />
