Capacete #2998 Search Warrant SAPD 23-07962 <br />Page 7 of 10 <br /> <br />According to Sergeant Wharton, Officers arrived on scene and removed the front passenger from the vehicle <br />and took him into custody without incident. The passenger was identified as Roberto Gonzalez-Diaz (DOB: <br />07-26-90). He was transported to the Santa Ana Police Department. Officers Cofer and Santaella were also <br />transported to the Santa Ana Police Department. <br /> <br />At approximately 6:45 PM, Melgarejo was located by officers down along the east sidewalk at 437 S. Shelton <br />Street, suffering from several gunshot wounds to his body. Officers provided medical care to Melgarejo, until <br />the arrival of Orange County Fire Authority. Melgarejo was transported to OC Global Medical Center where <br />he was subsequently listed in stable condition. Melgarejo was in possession of an Apple IPhone with a clear <br />case and a baseball hat with a “B” logo. The Apple IPhone with a clear case and baseball hat were booked <br />into evidence at the Santa Ana Police Department under CI# 2023-07973 by Crime Scene Officers. <br /> <br />Public Safety Statements were obtained from both officers at the scene. Officer Cofer advised he fired <br />approximately eight rounds in a northerly direction from the driver’s side of the marked unit. Officer Santaella <br />advised he fired six rounds in a northerly direction from the front passenger side of the unit. They were both <br />uncertain if the suspect was struck by gunfire and advised only one suspect was outstanding. The described <br />the suspect as a male Hispanic, wearing a black sweater, black hat and white shoes. <br /> <br />The Orange County District Attorney’s Office Special Assignments Unit, the Santa Ana Police Department <br />Homicide Section and the Santa Ana Police Department Internal Affairs Division responded to investigate the <br />various facets of the case. <br /> <br />During the scene briefing, Sergeant Wharton advised there were 11 cartridge cases located at the scene of <br />the Officer-Involved Shooting. A firearm belonging to the suspect was located to the right rear passenger <br />wheel of the suspect vehicle. A magazine was located near the driver side front wheel of the marked police <br />unit driven by Officer Cofer. <br /> <br />During a canvas by officers, officers viewed surveillance video that depicts Melgarejo running eastbound on <br />Myrtle Street, then southbound onto Shelton Street along the east sidewalk. A grey SUV is captured on video <br />driving southbound on Shelton Street and stopping at the west curb line. Two male subjects exit the <br />passenger side and fire multiple rounds in Melgarejo’s direction. Upon conducting further investigation, a total <br />of 12 cartridge cases were discovered along the west sidewalk, south of Myrtle. As a result, a separate <br />Crime Report was generated listing Melgarejo as a victim of this shooting under CI# 2023-07973. <br /> <br />A homicide detective and D.A. Investigator responded to OC Global in an attempt to conduct an interview <br />with Melgarejo. Although Melgarejo was listed in stable condition, he was heavily medicated and could not <br />
