IiNS1!FsAr1Ut ivOT FsE i;.�REL' <br />C^L E R K <br />A-2008-075-21 A <br />%TP <br />J � FIRST AMENDMENT TO AGREEMENT <br />/ THIS FIRST AMENDMENT TO AGREEMENT is entered into this day of <br />2010, by and between the City of Huntington Beach ("Sub -Recipient") <br />and the City of Santa Ana, a charter city and municipal corporation of the State of <br />California ("Grant Administrator"). <br />Recitals: <br />71 <br />U A. The parties entered into Agreement #A-2008-075-21, dated 4/13/09, (hereinafter <br />3 "said Agreement") for the purchase of radio equipment for FY07 Public Safety <br />C4— Interoperable Communications (PSIC). <br />�f <br />W <br />B. The Grant Administrator previously adopted a resolution authorizing the City Manger <br />and the Chief of Police to execute a grant award agreement with the State of <br />California, Office of Homeland Security (OHS) for the FY2007 Public Safety <br />Interoperable Communications (PSIC) funding program in the amount of <br />$12,748,170. <br />C. The Grant Administrator was awarded additional funding in the amount of $196,774 <br />from the California Emergency Management Association (previously the Governor's <br />Office of Homeland Security) for the PSIC Grant Program, which was accepted by <br />the Santa Ana City Council in Resolution No. 2009-054, which also authorized and <br />directed the City Manager and Chief of Police, or their designees, to accept and <br />authorize the additional grant award, and to take any necessary action to obtain this <br />funding and sub -grant the same. <br />D. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term of said Agreement and update the reimbursement to the Sub - <br />Recipients based upon the remaining funding and the federal government's extension <br />of the term of the grant. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of the Agreement, except those amended in this First <br />Amendment to Agreement, the parties agree as follows: <br />Section 101, TIME OF PERFORMANCE, shall be amended to extend the term of <br />said Agreement to end on December 31, 2010 or upon the final disbursement of the <br />Grant Amount (as defined in Section 201) and any additional period of time as is <br />required to complete any necessary close out activities. <br />2. Section 201, PAYMENT OF GRANT FUNDS AND METHOD OF PAYMENT, <br />subsection A, shall be amended as follows: GRANT ADMINISTRATOR will <br />reimburse Sub -Recipient for the purchase of an additional 100 authorized 700 MHz <br />pieces of equipment, in accordance with grant regulations. <br />
