a <br /> FIRST AMENDMENT WITH LANDSCAPE WEST MANAGEMENT SERVICES INC. <br /> TO AGREEMENT TO PROVIDE MEDIAN LANDSCAPING RIGHT OF WAY AND <br /> HOMELESS DEBRIS REMOVAL SERVICES <br /> THIS FIRST AMENDMENT to the above-referenced agreement is entered into on May 5, 2026, <br /> by and between Landscape West Management Services, Inc. ("Contractor"), and the City of Santa <br /> Ana, a charter city and municipal corporation organized and existing under the Constitution and <br /> laws of the State of California("City"). <br /> RECITALS <br /> A. The parties entered into Agreement No. A-2025-083, dated June 3, 2025, by which <br /> Contractor agreed to provide landscaping maintenance and irrigation systems maintenance <br /> of street medians and public right-of-way amenities, vacant lots/parcels, slopes, channels, <br /> and easements("Agreement"). <br /> B. The initial term of the Agreement runs for a three (3) year term from July 1, 2025 through <br /> June 30, 2028,with an option to grant up to two (2) one(1)year extensions through 2030. <br /> The Agreement is current and in-effect. <br /> C. City and Contractor previously entered into a Blanket Order Contract #8696 to provide <br /> homeless encampment and debris removal services with an annual budget of$500,000. <br /> Blanket Order Contract#8696 is set to expire on July 6, 2026. <br /> D. The scope of services to the Agreement also allows for the same services provided in the soon <br /> to expire Blanket Order Contract. <br /> E. The parties now wish to amend the Agreement to increase the amount to be expended under <br />$ the Agreement to compensate the Contractor for the continuation of services intended to <br /> maintain public spaces free of debris and encampments, and open for safe use by residents, <br /> businesses and stakeholders of Santa Ana. <br /> The Parties therefore agree: <br /> 1 1. Section 2, Compensation, is amended to increase the not-to-exceed expenditure under the <br /> Agreement by$500,000 for each annual term of the Agreement,including any option to extend I <br /> the term of the Agreement, commencing on July 1, 2026. The total amount to be expended <br /> during the remaining term of the Agreement, including any extension, shall not exceed <br /> $11,370,000. <br /> 1 <br /> _.
