EXBNIETH H <br /> SIGNATURES & ASSURANCES <br /> The assurances are: <br /> 1. I am authorized by my Board of Directors, Trustees, or other legally qualified officer to <br /> submit this proposal on behalf of the"Applicant." <br /> 2. Applicant is not currently on any federal, State of California or local Debarment List. <br /> 3. Applicant will provide records to show fiscal solvency, if required. <br /> 4. Applicant will meet all applicable Federal, State and local compliance and regulatory <br /> requirements. <br /> These include but are not limited to <br /> a. Ensuring that records accurately reflect actual performance; <br /> b. Maintaining record confidentiality, as required; <br /> c. Reporting financial participant, and performance data, as required; <br /> d. Meeting requirements of Section 504 or the Rehabilitation Act of 1973; <br /> e. Meeting all applicable labor laws, including Child Labor Law standards; and <br /> f. Meeting all lobbying certification and disclosure of lobbying activities requirements. <br /> 5. Applicant will establish, in accordance with section 184 of the Workforce Innovation & <br /> Opportunity Act, fiscal control and fund accounting procedures necessary to ensure the <br /> proper disbursement of, and accounting for funds provided to the Local Workforce <br /> Development Board. <br /> 6. That it will comply with the uniform administrative requirements referred to in WIOA. <br /> 7. Compliance with the confidentiality requirements of WIOA. <br /> 8. That no funds received under the Workforce Innovation & Opportunity Act will be used to <br /> assist, promote or deter union organizing. <br /> 9. That it will comply with the nondiscrimination provisions of WIOA, including an assurance <br /> that Methods of Administration have been developed and implemented. <br /> 10. That it will collect and maintain data necessary to show compliance with the <br /> nondiscrimination provisions of WIOA. <br /> 11. That there will be compliance with grant procedures of WIOA. <br /> 12. That all funds will be spent in accordance with the Workforce Innovation & Opportunity <br /> Act, written Department of Labor guidance, and other applicable Federal and State laws <br /> and regulations. <br /> 13. That it will endeavor to partner and plan with such entities, that the SAW DB, its <br /> subcommittees or staff direct, including regionally, statewide or nationally. <br /> 14. That it will comply with such new regulations that are set forth in the new Law that will <br /> govern the activities set forth herein. <br /> 15. That it will comply with new policies initiated by the State of California, City of Santa Ana, <br /> as appropriate. <br /> 16. Respondent will not: <br /> a. Place a customer in a position that will displace a current employee; <br /> b. Use WIOA money to assist, promote, or deter union organizing; <br /> c. Use funds to employ or train persons in sectarian activities; and <br /> d.
