3. PROGRAM COMPLIANCE <br />A. Program Obligations of Tenant. The Tenant remains responsible for all rent due <br />under their operative rental agreement with Landlord. This Contract and the rental <br />assistance paid by the City to the Landlord in no way extinguishes the obligation <br />of the Tenant to pay rent or any other monies due under the operative rental <br />agreement between the Tenant and Landlord. The Tenant is also responsible for <br />any rent not covered by the Rental Assistance Payment for that given month under <br />this Program. Each month the Rental Assistance Payment amount paid by the <br />City for the benefit of the Tenant is gradually reduced, and the Tenant is <br />responsible for paying the remaining balance of rent owed. <br />B. Tenant Portion of the Rent. Tenant will continue to make the following timely rent <br />payments directly to Landlord for the duration of the Contract (which is the <br />difference between the monthly rent for the Subject Property less Rental <br />Assistance Payments): <br />lonth 1 (July 2026); <br />Month 2 (August 2026); <br />Month 3 (September 2026); <br />,Ionth 4 (October 2026); <br />Month 5 (November 2026); <br />Month 6 (December 2026) <br />C. Program Limitations. The Program and Rental Assistance Payments are <br />confinpenf on Program compliance with the State of California, and funding from <br />the State of California. Should HHAP funding be withdrawn or otherwise <br />terminated, the City will have no further obligation to fund this Contract or issue <br />any Rental Assistance Payments. <br />D. Representations of Tenant. Tenant agrees to provide accurate and honest <br />information to the City and its staff. Tenant agrees to provide the City with proof <br />of income, current rental agreement, a written release to allow the City to <br />communicate with Landlord about Tenant's tenancy (if needed), and any other <br />information or documents necessary to stay in compliance with the Program, or as <br />otherwise needed for compliance with any requests by the State of California in <br />conjunction with HHAP funding. Tenant agrees to pay Tenant's portion of the rent <br />on time every month and immediately advise the City if Tenant cannot make timely <br />payment. <br />E. Tenant Vacate. If the Tenant vacates the Subject Property, for any reason, the <br />Tenant agrees to notify the City by telephone and in writing within twenty-four (24) <br />hours of Tenant vacating from the Subject Property. Failure to provide timely <br />notification of a vacate date during the Contract term may result in Tenant's <br />disqualification from future participation in rental assistance programs with the City. <br />Upon confirmation of Tenant's move -out during the term of this Contract, this <br />Contract shall be automatically terminated and no further Rental Assistance <br />Payments will be made to Landlord. <br />i7 <br />DOCSOC/1662707v3/022363-0011 <br />
