March 12, 2019 <br />0335 Hours <br />Orange County District Attorney Investigator C. Gonzalez and I interviewed Orange County Deputy <br />Probation Officer II (DPO) C. PINTO at the police department¶s 3rd floor conference room. Present in the <br />interview were Association of Orange County Deputy Sheriff¶s (AOCDS) Attorney Jan CHRISTI and <br />AOCDS Staff Representative Frank FLAVIN. Investigator audio recorded the interview and the following is <br />a synopsis of said interview. <br />DPO PINTO has worked for the County of Orange for approximately 11 years and has been a Probation <br />Officer for the last 7 years. On 3/11/19, he and his partner DPO L. IBARRA were working gang <br />suppression along with members of the Santa Ana Police Department¶s (SAPD) Gang Unit. As part of their <br />duties, DPO¶S PINTO and IBARRA are assigned to the SAPD Gang Unit and work alongside the Gang <br />Detectives on a regular basis. <br />On the night of this incident, he was driving a Probation Department unmarked black Ford Explorer as DPO <br />IBARRA was passenger. DPO IBARRA had mentioned to him that he had a probationer on his caseload <br />(Miguel ISRA) who lived at 1821 S. Cedar #D. DPO IBARRA stated that as they drove through the Cedar / <br />Evergreen, DPO IBBARA stated that if they saw ISRA out in the area, he would want to talk to him to see if <br />he was in compliance with his probation. <br />'32 3,172 VDLG WKDW KH DQG WKH *DQJ 8QLW 'HWHFWLYH ZHUH FRQGXFWLQJ D SDWURO FKHFN DW D 1HW &DIp LQ WKH <br />area of Edinger and Standard. After the patrol check, they proceeded to the Cedar / Evergreen area. He <br />followed one of marked Detective Units west on Occidental. The Detectives then traveled north in the east <br />alley of Cedar Street. PINTO said he drove north on Evergreen Street paralleling the unit in case someone <br />ran out toward their direction. DPO PINTO said he and DPO IBARRA were approximately one building <br />north of 1814 S. Evergreen when he clearly heard 3 to 4 loud gunshots. He believed that gunshots were <br />being fired south of them. They were exiting their probation vehicle, when he heard an additional 3 to 5 <br />gunshots. <br />DPO PINTO stated that he and DPO IBARRA were walking south along the west sidewalk when he <br />observed a male walking general area of where the gunshots were coming from. Not knowing if the male <br />was involved in the shooting, PINTO and IBARRA detained the male. They detained an additional subject <br />who was in the courtyard of 1814 S. Evergreen Street. DPO PINTO stated that while they contacted the <br />two males, he heard yelling and someone say ³´(man with gun) over the police radio. <br />DPO PINTO said that remained on Evergreen Street, while officers were responding to the west alley. <br />They did not respond to where the officer involved shooting occurred. <br />DPO PINTO stated that the Cedar / Evergreen area is a highly active gang neighborhood. They have <br />contacted numerous probationers in the area. Last week they contact two individuals where one of the <br />individuals tossed a handgun. <br />We concluded the interview. <br />Investigator Gonzales provided me a copy of the audio recording, which I later booked into SAPD <br />Evidence.
