<br /> <br /> <br /> <br /> <br /> <br /> It is the intent of the parties that no additional paid time off shall be gained or lost <br /> as a result of the implementation of either the 4/10, the 3/11.5 plus 115.5, or the <br /> 9/80 work schedules. The City reserves the right to abandon either the 4/10, the <br /> 3/11.5 plus 115.5, or the 9/80 work schedules for these employees if, in the <br /> opinion of the concerned Department Head and the City Manager, either the 4/10, <br /> the 3/11.5 plus 115.5, or the 9/80 work schedules has not produced the desired <br /> results. If this right is exercised, however, the City and SEIU shall meet and <br /> confer in good faith prior to abandoning any of these work schedules. <br /> <br /> D. Any employee having been authorized to work the 9/80 work schedule who <br /> subsequently encounters a personal hardship with his/her work hours may request <br /> an accommodation from his/her Department Head. A "hardship request" will be <br /> limited to an employee's authorized hours of work. An accommodation will be <br /> considered only after the employee has exhausted all other personal options to <br /> resolve the hardship. <br /> <br /> If the employee is unable to resolve his/her problem, the employee may request an <br /> accommodation from their Department Head by submitting a hardship claim. The <br /> Department Head may authorize an accommodation after reviewing said claim or <br /> assign a manager to investigate and recommend a resolution of the hardship <br /> claim. The recommendation of the manager will be limited to the following: <br /> <br /> 1. Approve an appropriate flex schedule that does not disrupt the department <br /> ability to deliver its services or create disruption in the work unit. <br /> <br /> 2. Disapprove the employee's proposed solution to resolve the hardship. <br /> <br /> 3. Reassign the employee to a 5/40 work schedule. <br /> <br /> The Department Head may accept any one of the manager's recommendations or <br /> advance his own to resolve the hardship. <br /> <br /> E. The Water Production staff will work an eight (8) hour day shift covering <br /> Monday through Friday. Employees will be required to take a 30 minute unpaid <br /> lunch break during the shift. <br /> <br /> 3.3 Employee Furloughs. Beginning October 2010 and ending in February 2012, employees <br /> covered by this agreement shall take twenty (20) eight-hour unpaid furlough days totaling <br /> 160 hours. Employees covered by this agreement shall furlough one day a month except <br /> two additional days shall be taken in December of 2010 and one additional day shall be <br /> taken in December 2011. Furloughing shall be on a set day agreeable to the City and <br /> union. However, for those departments or divisions identified by the City as having a <br /> business necessity, the furlough schedule shall be based on those operational needs. <br /> Employees in departments or divisions with special needs may bank furlough hours <br /> which shall be taken at the discretion of the employees with the approval of their <br /> <br /> <br /> 10 <br /> 25F-12 <br />
