IWIIPANU ON FII_F lP �� i IN UI {PIKES I.L._ ;r: SEP 1 4 ?01D ®: PWA (1) JOe Parc 0 SECOND AMENDMENT TO AGREEMENT N-2008-094-02 THIS SECOND AMENDMENT TO AGREEMENT is entered into on September 1, 2010, by and between AMEC Geomatrix Consultants, Inc., a California corporation ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). Recitals: A. The parties entered into Consultant Agreement N-2008-094 dated July 9, 2008, (hereinafter "said Agreement") by which Consultant has provided commercial industrial NPDES permit inspections. B. In accordance with the terms and conditions of said Agreement, the parties wish to renew said Agreement for an additional one-year period and to increase compensation to pay for services during the extended term. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Second Amendment to Consultant Agreement, the parties agree as follows: 1. Section 1, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with the following: "Consultant shall conduct Facility Inspections, Inventory Management and Enforcement Notifications, as set forth in Exhibit A-1, attached hereto." 2. Section 2.a., COMPENSATION, shall be amended to increase compensation by $25,000 to pay for services provided during the 2010-11 fiscal year. 3. Section 3, TERM, shall be amended to extend the termination date to June 30, 2011. In order to provide uninterrupted service, the parties agree that those services provided since July 1, 2010 shall be included within the Scope of Services of this Second Amendment to Agreement. 4. Except as herein amended, all terms and conditions of said Agreement shall remain in full force and effect. ///
