a. If the Department Head does not support the employee's <br />request for a classification review, he or she shall notify <br />the employee of this decision in writing and set forth the <br />basis for the decision. <br />b. If the Department Head does not support the employee's <br />request, but agrees that some of the duties and/or <br />responsibilities being performed by the employee are <br />those of a higher level City classification, he or she can <br />do the following: <br />Return the employee to performance of the duties <br />and/or responsibilities of their proper classification. <br />2. Eliminate the higher duties and/or responsibilities <br />being performed by the employee, for which the <br />City has agreed are those for which it shall provide <br />higher compensation. <br />B. Any employee request for classification review approved by the <br />Department Head shall be forwarded to the Executive Director of <br />Personnel Services. The Executive Director of Personnel Services shall <br />confirm receipt of the request in writing to the employee. Within sixty <br />(60) days of receipt of the request, the Executive Director of Personnel <br />Services shall notify the employee and Department Head of the <br />decision as to whether a study will be conducted. If the Executive <br />Director of Personnel Services determines that a study is appropriate, <br />the Executive Director of Personnel Services shall so notify the <br />employee and the Department Head in writing and shall provide the <br />employee and Department Head with an approximate start date for <br />the study. <br />C. All determinations of the Department Head and the Executive Director <br />of Personnel Services are final. <br />D. All studies and study findings shall require City Manager approval <br />before proceeding. <br />E. All recommendations resulting from study findings require the approval <br />of the City Council and shall be implemented in accordance to the <br />City's Civil Service rules. <br />CONFIDENTIAL ASSOCIATION OF SANTA ANA (CASA) MOU: 2010 - 2012 Page 17 <br />25E-19
