a. Premiums have been paid on behalf of the former <br />employee until all monies are exhausted; or <br />b. The sum of premiums paid equals one hundred fifty <br />percent (150%) of the amount of the lump sum payment <br />that the employee would have received for unused sick <br />leave benefits had this option not been elected. <br />C. Except in cases of disability retirement, upon <br />nondisciplinary termination of employment after fifteen <br />(15) years of cumulative full-time service with the City, <br />each qualified employee shall be entitled to payment for <br />two-thirds (2/3) of the total sick leave benefit credited to <br />his or her account upon the effective date of such <br />termination to be applied toward health insurance <br />premiums only as specified in Section 11.1.K.2 above, <br />excluding Subsections a and b. <br />11.2 Bereavement Leave. <br />A. An employee covered under this Agreement shall be granted up to <br />three (3) working days leave without loss of pay in the case of a death <br />of a member of the employee's immediate family. Such leave is <br />designated as bereavement leave. "Immediate family" as used in this <br />section is limited to: <br />1. Any member of the employee's household related by blood or <br />marriage; <br />2. A parent, parent-in-law, stepparent, spouse, child, brother, sister, <br />stepbrother, stepsister, grandparent or grandchild of the <br />employee, regardless of residence; <br />3. Any other relative of the employee by blood or by marriage <br />where it can be established by the employee that as a result of <br />such relative's death, the employee's presence is required to <br />handle funeral arrangements and/or matters of estate. <br />B. Whenever an employee is required to travel one way more than 500 <br />miles to attend to the death of a member of the employee's <br />immediate family, an employee may use up to sixteen (16) hours of <br />additional leave charged to their Personal Necessity Leave balance <br />when authorized by the Department Head. <br />CONFIDENTIAL ASSOCIATION OF SANTA ANA (CASA) MOU: 2010 - 2012 Page 42 <br />25E-44
