INsURA1NCE ON VILE WORKSvIAY PROCEED UNTIL INSURANCE EXPIRES 1 - '7 FIRST AMENDMENT TO CLERK,OF COUNCIL CONSULTANT AGREEMENT DATE: cJ-j-03 THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT, is entered r'se.~l into on July 1, 2003, by and between Torres Maintenance Co., a California corporation ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). Recitals: A. The parties entered into Agreement No. N-2003-042, dated April 29, 2003, (hereinafter "said Agreement") by which Consultant cleans the ranges for the Police Department shooting ranges and removes lead therefrom. B. In accordance with the terms and conditions of said Agreement, the parties wish to extend sid Agreement for an additional one year period and increase the compensation to pay for services during that one year period. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Consultant Agreement, the parties agree as follows: 1. Section 1, SCOPE OF SERVICES, shall be amended to include services as described in Exhibit A-1, attached hereto and made a part hereof. 2. Section 2.a., COMPENSATION, shall be amended to read as follows: "City agrees to pay and Consultant agrees to accept as total payment for its services, the rates and charges identified in Exhibit A-1 ofthis Amendment. The sum to be expended under this Agreement shall not exceed $6,500.00 during the 2003-04 fiscal year. The total sum to be expended under this Agreement shall not exceed $11,000.00 during the term of this Agreement." 3. Section 3, TERM, shall be amended to read as follows: "This Agreement shall commence on April 29, 2003 and terminated on June 30, 2004, unless terminated earlier in accordance with Section 12, below. The term of this Agreement may be extended upon a writing executed by the Chief of Police and the City Attorney." 4. Except as hereinabove modified, all terms and conditions of said Agreement shall remain in full force and effect.
