<br /> <br /> REQUEST FOR <br /> COUNCIL ACTION <br /> <br /> CITY COUNCIL MEETING DATE: CLERK OF COUNCIL USE ONLY: <br /> October 4, 2010 <br /> TITLE: APPROVED <br /> E3 As Recommended <br /> RESOLUTION RESCINDING PREVIOUS O Amended <br /> 0 Or <br /> dinance on 1 "Reading <br /> CITY COUNCIL ACTIONS AMENDING THE 0 Ordinance on 2nd Reading <br /> ADULT SOCCER SURCHARGE AND O Implementing Resolution <br /> REESTABLISHING THE SURCHARGE FOR O Set Public Hearing For <br /> FISCAL YEAR 2010-2011. <br /> CONTINUED TO <br /> FILE NUMBER <br /> CITY MANAGER <br /> RECOMMENDED ACTION <br /> Adopt a resolution rescinding City Council actions taken on June 21, 2010 and September 7, 2010 <br /> amending the Adult Soccer Reservation Surcharge and establishing the Surcharge for FY 2010- <br /> 2011. <br /> DISCUSSION <br /> On June 7, 2010, by Resolution 2010-023, the City Council adopted the Miscellaneous Fee <br /> Schedule for Fiscal Year 2010-11 as part of the City's annual budget. On June 21, 2010 the City <br /> Council amended Resolution 2010-023 to reduce the Adult Soccer Reservation Surcharge from <br /> $28.18 per game to $14 per game. The purpose of the surcharge fee is to generate revenue to <br /> convert a natural turf field to synthetic at the Dan Young Soccer Complex. <br /> Shortly after the vote, as part of the actions taken by Resolution 2010-043, the City Council further <br /> reduced the Adult Soccer Reservation Surcharge from $14 per game to $14 per day, and <br /> suspended its collection for Fiscal Year 2010-2011. <br /> Late in the week of September 7, 2010, Councilmembers Martinez and Tinajero notified City Staff <br /> that they had become aware for the first time that they had each received a campaign contribution <br /> in the amount of $500 from United Latin Soccer League, inc., one of the seven adult soccer <br /> leagues that have annual reservation rights and are required to pay the Surcharge. Voting on <br /> changes to. the Adult Soccer Reservation Surcharge in light of those contributions could be <br /> construed as a violation of Charter Section 425. <br /> In a letter to Mayor Pulido dated September 10, 2010, Councilmember Tinajero requested the <br /> Mayor take steps to rescind and revote on the Soccer Surcharge matters so that the Council, <br /> without his participation as well as that of Councilmember Martinez, could rectify the matter. At the <br /> Mayor's request, this Council action item has been prepared to rescind both the June 21, 2010 <br /> amendment to the Surcharge as well as the September 7, 2010 amendment. <br /> 55C-1 <br />
