KO-1 /24/08 <br />RESOLUTION NO. 2008-04 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA APPROVING VARIANCE NO. <br />2007-14 AS CONDITIONED TO ALLOW A REDUCTION IN <br />THE FRONT YARD LANDSCAPE SETBACK FOR A NEW <br />INDUSTRIAL BUILDING TO BE CONSTRUCTED ANA <br />DENIAL OF VARIANCE NO. 2007-15 TO ALLOW AN <br />EXISTING NON-CONFORMING POLE SIGN FOR THE <br />PROPERTY LOCATED AT 1701 SOUTH GRAND AVENUE <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA <br />AS FOLLOWS: <br />Section 1. The Planning Commission of .the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Applicant is requesting approval of Variance No. 2007-14 to allow a <br />reduction in the front yard landscapessetback for a new industrial building to <br />be constructed and Variance No. 2007-15 to allow an existing non- <br />conforming pole sign to remain on the subject site at 1701 South Grand <br />Avenue. <br />B. Variance No. 2007-14 and Variance No. 2007-15 came before the <br />Planning Commission of the City of Santa Ana for a duly noticed public <br />hearing on January 28, 2008. <br />C. Variance No. 2007-14 has been filed with the City of Santa Ana seeking to <br />reduce the required front yard landscape setback as required by Section <br />475(a)(i). Per Section 41-475(a)(i), a 20-foot wide front yard landscape <br />setback must be provided along the entire length of the front yard as the <br />property abuts an arterial street. The applicant is requesting to maintain <br />the six (6) foot landscape setback that currently exists in front of the <br />existing building. <br />Santa Ana Municipal Code Section 41-638 authorizes the Planning <br />Commission to grant a variance upon making certain findings. <br />That because of special circumstances applicable to the <br />subject property, including size, shape, topography, location, <br />or surroundings, the strict application of the zoning <br />ordinance is found to deprive the subject property of <br />Resolution No. 2008-04 <br />Page 1 of 8 <br />
