• 1. That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or <br />surroundings, that the strict application of the zoning ordinance is <br />found to deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this <br />Chapter. <br />There are special circumstances applicable to the subject <br />property. Due to the location of the building on the corner of <br />a major intersection and the size of the elevation, the <br />installation of additional signage will allow Original Mike's the <br />ability to identify the restaurant. <br />2. That the granting of a variance is necessary for the preservation <br />and enjoyment of one or more substantial property rights. <br />The granting of the variance for an additional wall sign is <br />necessary to preserve property rights, which allows the <br />restaurant the ability to properly identify the business. <br />3. That the granting of a variance will not be materially detrimental to <br />the public welfare or injurious to surrounding property. <br />• The granting of a variance for the additional wall sign will not <br />be detrimental to the area. The existing sign, which is 104 <br />square feet, in conjunction with the proposed 50 square feet <br />sign would not exceed the maximum area allowed by code. <br />Additionally, the proposed wall sign is proposed to be placed <br />on the north elevation, away from any residential uses. <br />Finally, due to the size of the north elevation and the <br />removal of two existing wait signs that were allowed under a <br />previously approved variance, the installation of an <br />additional wall sign will not result in visual clutter on the <br />premises. <br />4. That the granting of a variance will not adversely affect the General <br />Plan of the City. <br />The granting of the proposed variance will not adversely <br />affect the General Plan of the City. The land use <br />designation of General Commercial (GC) allows signage in <br />conjunction with retail uses. <br /> <br />Resolution No. 2006-032 <br />Page 2 of 6 <br />
