LSA ASSOCIATES, INC. <br />JULY 2010 <br />INITIAL STUDYIMITIGATED NEGATIVE DECLARATION <br />FIRST STREET BRIDGE REPLACEMENT PROJECT <br />CITY OF SANTA ANA <br />project area has suitable habitat and/or is within the elevation or distribution range for only some of <br />these species. A total of one plant and 12 animal species have at least low potential for occurrence <br />and are listed below. <br />• Southern tarplant (Centromadia parryi ssp. australis) <br />• Monarch butterfly (Danaus plexippus) <br />• California legless lizard (Anniella pulchra pulchra) <br />• Burrowing owl (Athene cunicularia) <br />• Coopers' hawk (Accipiter cooperii) <br />• Merlin (Falco columbarius) <br />• Allen's hummingbird (Selasphorus sasin) <br />• California horned lark (Eremophila alpestris actia) <br />• Western yellow bat (Lasiurus xanthinus) <br />• Yuma myotis (Myotis yumansis) <br />• Pallid bat (Antrozous pallidus) <br />• Big free -tailed bat (Nyctinomops macrotis) <br />No special-status/special-interest species (i.e., listed species, species proposed for listing, candidate <br />species, or species of interest) were observed or otherwise detected on site at the time of the site <br />visits. Most potentially occurring species are either not expected or have a low probability of <br />occurrence, but two bird species have low -moderate occurrence probability. Marginally suitable <br />habitat exists within the project limits for foraging and nesting Cooper's hawk (Accipiter cooperii), a <br />California Species of Special Concern species. Similarly, marginally suitable habitat exists within the <br />project limits for foraging and nesting Allen's hummingbird (Selasphorus Basin), a Special Animal. <br />Although these species were not observed during the surveys, it is likely that these species occur <br />occasionally within and near the site. In addition, the bat species may be affected by loss of roosting <br />habitat if bats are found to be day -roosting in the bridge structure. Overall, the project area is highly <br />developed and no signs of special status/special interest animal species were observed. <br />All native nesting birds are protected by the federal Migratory Bird Treaty Act (MBTA). The <br />proposed project is required to comply with the MBTA which prohibits disturbing or destroying <br />active nests. Project implementation must be accomplished in a manner that avoids impacts to active <br />nests during the breeding season. As documented in Mitigation Measure BIO -1, avoiding impacts can <br />be accomplished through a variety of means, including restricting brush and tree removal, if required, <br />to periods outside the avian nesting season (February 15 through August 15) or through performance <br />of nesting bird surveys prior to clearing when clearing occurs during the nesting season.
