<br />RESOLUTION NO. 2005-26 <br />KO - 8/24/05 <br />A RESOLUTION OF THE PLANNING <br />COMMISSION OF THE CITY OF SANTA ANA <br />APPROVING CONDITIONAL USE PERMIT NO. <br />2005-21 AS CONDITIONED TO ALLOW ADRIVE- <br />THROUGH WINDOW AND APPROVING THE <br />MODIFICATION OF VARIANCE NO. 1995-09 FOR <br />THE PROPERTY LOCATED AT 3770 WEST <br />MCFADDEN AVENUE <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Applicant has filed Conditional Use Permit No. 2005-21 seeking to allow a <br />drive-through window service and to modify Variance No. 1995-09 to allow <br />the further reduction of parking spaces for the property located at 3770 <br />West McFadden Avenue. <br />B. Conditional Use Permit No. 2005-21 and the modification of Variance No. <br />1995-09 came before the Planning Commission of the City of Santa Ana <br />for a public hearing August 8, 2005. <br />C. Santa Ana Municipal Code Section 41.424.5 permits eating <br />establishments with drive-through service with a conditional use permit. <br />Santa Ana Municipal Code Section 41-638 authorizes the City Council to <br />grant a conditional use permit upon making certain findings. <br />1. Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood or the <br />community? <br />The proposed Starbucks drive-through will contribute to the <br />general well being of the area by providing a new restaurant <br />with amenities available to both pedestrians and vehicles <br />traveling along Harbor Boulevard and McFadden Avenue. <br />2. Will the proposed use under the circumstances of the particular <br />case be detrimental to the health, safety or general welfare of <br />persons residing or working in the vicinity? <br />• The drive-through window service, in conjunction with the <br />proposed conditions, will not be detrimental to the health, <br />Resolution No. 2005-26 <br />Page 1 of 5 <br />
