<br />RESOLUTION N0.2003-41 <br />Koo-10/27/03 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF SANTA ANA FOR A REDUCTION <br />IN THE REQUIRED REAR YARD SETBACK FOR <br />THE PROPERTY LOCATED AT 1101 WEST SANTA <br />ANA BOULEVARD <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. The Planning Commission held a duly noticed public hearing on October 27, <br />2003, on Variance No. 2003-04, for a reduction in the required rear yard set <br />back for the property located at 1101 West Santa Ana Boulevard. <br />r ~ <br />~_.J <br />B. Santa Ana Municipal Code Section 41-638 authorizes the Planning <br />Commission to grant a variance upon making certain findings. <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or surroundings, <br />that the strict application of the zoning ordinance is found to deprive <br />the subject property of privileges not otherwise at variance with the <br />intent and purpose of the provisions of this chapter. <br />Due to the size of the lot and the surrounding property uses, <br />the denial of the variance would deprive the property owner <br />the privilege of constructing a quality office development. <br />Additionally, by requiring the required rear yard setback would <br />create a dead end situation for the on-site parking spaces. <br />2. That the granting of a variance is necessary for the preservation and <br />enjoyment of one or more substantial property rights. <br />The granting of the variance would allow the property owner <br />the opportunity to develop on a project site that otherwise <br />would not allow a quality office development. Not allowing the <br />variance would force the applicant to construct a smaller and <br />less business friendly office building. <br />• 3.
