than 20,000 square feet of floor area which are open between the <br />hours of 12:00 a.m. and 5:00 a.m. in the C5 zoning district. <br />2. Santa Ana Municipal Code Section 41-638 authorizes the Planning <br />Commission to grant a conditional use permit upon making certain <br />findings. <br />Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />the community? <br />The proposed after hours operation of the service <br />station and convenience store of between 12:00 a.m. <br />and 5:00 a.m. will allow motorists and the community <br />to purchase items generally unavailable during these <br />hours from other retail establishments. <br />Will the proposed use under the circumstances of the <br />particular case be detrimental to the health, safety, or <br />general welfare of persons residing or working in the <br />vicinity? <br />The after hours operation of the service station and <br />convenience store will not be detrimental to <br />individuals residing and working in the area. <br />Conditions have been incorporated into the project to <br />reduce adverse impacts that the project might <br />generate as the result of the after hours operation <br />such as the requiring that pay phones be located <br />within the interior of the store and ensuring that <br />visibility is maintained from the street to the interior of <br />the store will increase the safety of employees and <br />users of the site. The after hours operation of the <br />service station and convenience store, in conjunction <br />with the proposed conditions, will not be detrimental <br />to the health, safety or general welfare of persons <br />working in the area. <br />iii. Will the proposed use adversely affect the present economic <br />stability or future economic development of properties <br />surrounding the area? <br />The gasoline service station and convenience store <br />will generate City tax revenue and employment in the <br />community.
