Sale of safe and sane fireworks; hours of sale. <br /> <br /> No person shall display, sell, or engage in the business of selling safe and sane <br /> fireworks without first having obtained a permit to do so as hereinafter provided. No <br /> person shall sell any type of fireworks at any time except from 12:00 noon through <br /> 10:00 p.m. on July 1st; from 10:00 a.m. through 10:00 p.m. on July 2nd and 3rd; and <br /> from 10:00 a.m. through 8:00 p.m. on July 4th of any year. <br /> <br /> SECTION 68: That section 14-56 of the Santa Ana Municipal Code is hereby amended <br /> such that it reads as follows: <br /> <br /> Sec. 14-56. Permits, issuance. <br /> <br /> (a) Permits for the sale of safe and sane fireworks shall be issued only to <br /> bona fide nonprofit organizations as recognized by the State of California organized for <br /> charitable, fraternal, patriotic service or religious purposes with their principal and <br /> permanent meeting place within the City of Santa Ana, and at least fifty (50) per cent of <br /> the members residing within the city limits. <br /> <br /> (b) Permits for the sale of safe and sane fireworks shall limit each sponsoring <br /> organization to a single location in any given year. <br /> <br /> (c) Such permits shall expire on July 4th at 8:00 p.m. of the year of issuance. <br /> <br /> SECTION 69: That section 14-57 of the Santa Ana Municipal Code is hereby amended <br /> such that it reads as follows: <br /> <br /> Sec. 14-57. Application for permit. <br /> <br /> The number of fireworks booths allowed to operate in the City of Santa Ana will <br /> be limited to a maximum of 85 booths. Organizations that received a permit to operate a <br /> firework booth in the previous year will have their operational permit automatically <br /> renewed as long as the organization still meets the requirements listed in section 14-56, <br /> and have not had any violations of these regulations during the past operational season. <br /> <br /> If the number of returning organizations is less than 85 the open fireworks booth <br /> operation positions shall be filled by lottery during the following year fireworks season. <br /> <br /> <br /> Ordinance No. NS-XXXX <br /> 11 A-39 Page 39 of 43 <br />
