ZL=Y�S � THIS SECOND AMENDMENT TO AGREEMENT, is entered into this ��Y ' day of October, 201 O, by and between Stephen Howard Solomon (hereinafter "Contractor "), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California (hereinafter "City "). RECITALS- A. City and Contractor entered into Agreement #N- 2009 -027, dated February 26, 2009, for a Contractor having special skill and knowledge in the field of arbitration and mediation to provide professional administrative hearing services (hereinafter "said Agreement "). B. The parties entered into the First Amendment to Agreement, #N- 2009 - 027 -001 , dated December 17, 2009, in order to adjust the term and compensation of said Agreement. C. In accordance with the terms and conditions of said Agreement, the Parties desire to extend the term of said Agreement through the expenditure of the allocated funds. NOW, THEREFORE, in consideration of the mutual and respective promises, and subject to all the terms and conditions of said Agreement, except as herein modified, the parties agree as follows: Section 2, COMPENSATION, the relevant portion of subsection (a) shall be amended to provide that the total sum to be expended under this Agreement shall not exceed $25,000.00 during the extended term of this Agreement. 2. Section 3, TERM, shall be amended to extend the term of said Agreement to commence on the date first written above and terminate upon expenditure of all allocated funds. Except as hereinabove modified, all terms and conditions of said Agreement shall remain in full force and effect.
