G. EMPLOYER is able and willing to train eligible unskilled applicants to operate <br />said Program pursuant to the WIA and applicable federal, state and local laws. <br />WHEREFORE, for and in consideration of the respective and mutual covenants and <br />promises hereinafter contained and made, and subject to all the terms and conditions hereof, the <br />parties hereto do hereby agree as follows: <br />Term. The effective term of this Agreement is for the period beginning December 13, <br />2010, and ending April 30, 2011. The term of this Agreement may be extended upon <br />agreement of the City Manager or his/her designee and EMPLOYER. <br />2. Scope of Work. The EMPLOYER shall train up to 12 incumbent employee(s)/worker(s) <br />(hereinafter "Trainee(s)") in the occupation and in accordance with the Customized <br />Training Plan set forth in Exhibit A, attached hereto and incorporated herein by this <br />reference. <br />Training must significantly raise the Trainee from his/her prior position in level of skill <br />by the end of the training period. <br />A. Incumbent Worker Training <br />Incumbent workers must: <br />i. Be WIA eligible employees of Santa Ana companies and <br />ii. Earn less than the SAWIB self- sufficiency wage of $15.24 and <br />iii. NOT displace (including a partial displacement, such as a reduction in the <br />hours of non-overtime work, wages, or employment benefits) any <br />currently employed employee (as of the date of the participation). <br />2. Training may include but not limited to: <br />i. Skills upgrading or adapting skills of line staff <br />ii. Training of managers and supervisors to provide skills needed to assume <br />new functions and responsibilities within an at risk business. <br />3. Duration and Length of Activity <br />i. The training period shall not exceed 6 months. <br />B. Incumbent Worker Training Specifications <br />The proposed customized training must meet the following specifications: <br />1. Training may be designed for one business or a group of businesses <br />2. There must be a demonstrated need for training <br />i. Trainees must have a deficiency in the occupational skills required for <br />immediate employment in the position to be filled after training OR <br />ii. Business must identify new or changing regulations that require a change <br />in technology, software, waste reduction, energy conservation, etc. OR <br />iii. Identify changing skill requirements as a result of external economic or <br />market forces, significant changes in operating processes, rapidly <br />25H-4
