r <br />~~ <br />RESOLUTION N0.2002-12 <br />Kdo/05/22/02 <br />A RESOLUTION OF THE ZONING ADMINISTRATOR OF <br />THE CITY OF SANTA ANA APPROVING MINOR <br />EXCEPTION NO 2002-01 FOR THE PROPERTY AT 416 <br />SOUTH PACIFIC AVENUE <br />BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br />Section 1. The Zoning Administrator of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Minor Exception No. 2002-01 came before the Zoning Administrator of the <br />City of Santa Ana for a public hearing on April 3, 2002. <br />B. Minor Exception No. 2002-01 has been filed with the City of Santa Ana <br />seeking to permit a four and 1/2 foot fence in the front yard for the property <br />located at 416 South Pacific Avenue. <br />• C. The Zoning Administrator determines that the following findings, which must <br />be established in order to grant a minor exception from the provisions of the <br />Santa Ana Municipal Code, have been established: <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or surroundings, <br />the strict application of the zoning ordinance is found to deprive the <br />subject property of privileges not otherwise at variance with the intent <br />and purpose of the provisions of this chapter. <br />Due to the close proximity to a heavily traveled intersection <br />and the associated noise and traffic generated as a result, a <br />fence slightly above the code requirement is warranted at <br />this location. <br />2. That the granting of a variance or minor exception is necessary for <br />the preservation and enjoyment of one or more substantial property <br />rights. <br />The granting of Minor Exception No. 2002-01 will preserve and <br />secure the rights of the property owner. The existing fence, as <br />built, can only be reduced to a maximum height of 38 inches <br />• due to the configuration of existing masonry blocks. In this <br />instance, the fence will remain closer to compliance with the <br />Resolution No. 2002-12 <br />Page 1 of 3 <br />
