r~ <br />Kdo/1 /24/02 <br />RESOLUTION NO.2002-07 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA APPROVING VARIANCE NO. <br />2002-01 AS CONDITIONED FOR THE PROPERTY <br />LOCATED AT 3500 WEST MAC ARTHUR STREET <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Variance No. 2002-01 came before the Planning Commission of the City <br />of Santa Ana for a duly noticed public hearing on February 25, 2002. <br />B. The Applicant is requesting approval of a variance from the Santa Ana <br />Municipal Code Section 41-863(a) in order to allow a secondary sign on the <br />primary elevation for the property located at 3500 West MacArthur <br />Boulevard. <br />C. In accordance with California Environmental Quality Act, the proposed <br />project is exempt from further review. Categorical Exemption No. 00-17 <br />will be filed for this project. <br />D. The Planning Commission determines that the following findings, which <br />must be established in order to grant a variance from the provisions of the <br />Santa Ana Municipal Code, have been established: <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location, or <br />surroundings, the strict application of the zoning ordinance is found <br />to deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this <br />chapter. <br />Due to the relative size of the lot and the setback of the <br />building from the street, the installation of additional signage <br />will allow Home Depot the ability to identify a new service <br />available at the store.
