• RESOLUTION NO.O1-33 <br />A RESOLUTION OF THE ZONING ADMINISTRATOR <br />OF THE CITY OF SANTA ANA APPROVING MINOR <br />EXCEPTION N0.2001-01 TO ALLOW A THREE FOOT <br />HIGH FENCE IN THE FRONT YARD OF THE <br />PROPERTY LOCATED AT 1904 NORTH FLOWER <br />STREET <br />WHEREAS, Minor Exception No. 2001-01 came before the Zoning Administrator for a <br />public hearing on June 20, 2001, to permit a three foot high fence in the front yard of the property <br />located at 1904 North Flower Street, Santa Ana; <br />NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the above said hearing the Zoning Administrator <br />finds and determines as follows: <br />A. That because of special circumstances applicable to the subject property, including size, <br />shape, topography, location, or surroundings, the strict application of the zoning ordinance <br />is found to deprive the subject property of privileges not otherwise at variance with the <br />• intent and purpose of the provisions of this chapter. <br />Special circumstances exist in that the fence is built along the side property line, <br />where site visibility and emergency access will not be impeded. <br />B. That the granting of a minor exception is necessary for the preservation and enjoyment of <br />one or more substantial property rights. <br />The granting of Minor Exception No. 2001-01 will preserve and secure the rights of <br />the property owner for the enjoyment of property without undue concern, as the <br />fence has been constructed and cited by code enforcement. <br />C. That the granting of a variance will not be materially detrimental to the public welfare or <br />injurious to surrounding property. <br />The fence is a decorative polyvinyl picket fence with posts spaced at eight foot <br />intervals. The materials are compatible with the surrounding architecture and <br />consistent with existing neighborhood fences. The fence will not be detrimental and <br />injurious to surrounding property. <br />D. That the granting of a variance will not adversely affect the General Plan of the City. <br />• <br />1 <br />
