The 1.5-acre site is a commercial retail center that is suitable for the proposed use. <br />The addition of alcoholic beverages to the menu at Rubio's Baja Grill should <br />increase the patronage to the restaurant, thereby enhancing the profitability of the <br />business and identifying the use and site as economically stable and viable for the <br />surrounding properties in the area. <br />D. Will the proposed use comply with the regulations and conditions specified in Chapter 41 <br />for such use? <br />As conditioned, the proposed project will be in compliance with all applicable <br />regulations and conditions imposed on a restaurant selling beer and wine, pursuant <br />to Chapter 41 of the Santa Ana Municipal Code. <br />E. Will the proposed use adversely affect the General Plan or any specific plan of the City? <br />The proposed use will not adversely affect the General Plan. Restaurants and <br />ancillary uses such as Alcoholic Beverage Control licenses are permitted within the <br />General Commercial (C2) zoning district and the General Commercial (GC) <br />General Plan designation. Additionally, the use as conditioned is in compliance <br />with the regulations identified in the zoning code. <br />2. The Mitigated Negative Declaration and Mitigation Monitoring Program for <br />• Environmental Review No. 00-164 is hereby approved and adopted. Pursuant to Title XIV, <br />California Code of Regulations ("CCR") § 735.5(c)(1), it has been determined that, after <br />considering the record as a whole, there is no evidence that the proposed project will have the <br />potential for any adverse effect on wildlife resources or the ecological habitat upon which <br />wildlife resources depend. The proposed project exists in an urban environment characterized by <br />paved concrete, roadways, surrounding buildings and human activity. Therefore, pursuant to Fish <br />and Game Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game <br />Department filing fees is not required in conjunction with this project. <br />3.
