RESOLUTION NO.O1-24 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF SANTA ANA APPROVING <br />CONDITIONAL USE PERMIT NO.01-12 TO ALLOW A <br />60 FOOT HIGH MONOPOLE LOCATED AT 1125 <br />WEST CENTRAL AVENUE <br />WHEREAS, Conditional Use Permit No. 01-12 came before the Planning Commission for <br />a public hearing to allow a 60 foot high monopole telecommunication facility located at 1125 West <br />Central Avenue, Santa Ana; <br />WHEREAS, Santa Ana Municipal Code Section 41-638 authorizes the Planning <br />Commission to grant a conditional use permit upon making certain findings; <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the above-said hearing, the Planning Commission <br />finds and determines as follows: <br />A. Will the proposed use provide a service or facility which will contribute to the general <br />well being of the neighborhood or the community. <br />The height of the monopole will provide an improved cellular service to Santa Ana <br />residential and business customers. The proposed stealth design, location, and new <br />landscaping will reduce visual impacts to the neighborhood and community to <br />maintain the general well being of the neighborhood residents. <br />B. Will the proposed use, under the circumstances of the particulaz case, be detrimental to <br />the health, safety, or general welfaze of persons residing or working in the vicinity. <br />The Federal Communication Commission regulates the wireless telecommunication <br />industry through the Telecommunications Act of 1996. Local jurisdictions are not <br />permitted to address electrical magnetic emissions, as related to health issues, in <br />considering land use issues. <br />The subject site is located in on an Edison substation that abuts commercial <br />development on the west and multi-family residential on the east. Although the <br />proposed location does not meet the location guidelines for separation between the <br />use and residential properties, the distance between the Sprint lease area and east <br />property line abutting residential development is 165 feet. The residential <br />development on the south side is approximately 68 feet from the lease area. <br /> <br />
