RESOLUTION NO.O1-21 <br />• MINISTRATOR <br />A RESOLUTION OF THE ZONING AD <br />OF THE CITY OF SANTA ANA APPROVING <br />CONDITIONAL USE PERMIT NO.O1-06 TO ALLOW A <br />TYPE 47 ALCOHOL BEVERAGE CONTROL LICENSE <br />FOR ON-PREMISES CONSUMPTION OF BEER, WINE <br />AND DISTILLED SPIRITS AT MORTON'S OF <br />CHICAGO RESTAURANT, LOCATED AT 1641 WEST <br />SUNFLOWER AVENUE <br />WHEREAS, Conditional Use Permit No. 01-06 came before the Zoning Administrator for a <br />public hearing on April 4, 2001, to allow a Type 47 Alcohol Beverage Control License for on- <br />premises consumption of beer, wine and distilled spirits at the Morton's of Chicago restaurant, <br />located at 1641 West Sunflower Avenue, Santa Ana; and <br />WHEREAS, following said public hearing, the Zoning Administrator determined to <br />approve Conditional Use Permit No. 01-06, subject to conditions. <br />NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the abovesaid hearing the Zoning Administrator <br />finds and determines as follows: <br />A. Will the proposed use provide a service or facility which will contribute to the general well <br />being of the neighborhood or community? <br />The proposed ABC License for the restaurant will provide a service to the <br />community by allowing patrons the ability to consume alcoholic beverages on-site <br />with their meal. The ABC license will not negatively affect the surrounding <br />community as conditions of approval have been included to reduce potential <br />negative impacts and avoid the potential of an attractive nuisance being established <br />at this location. <br />B. Will the proposed use under the circumstances of the particular case be detrimental to the <br />health, safety or general welfare of persons residing or working in the vicinity? <br />The proposed ABC license will not be detrimental to persons residing and working <br />in the area as the use, as conditioned, will not create any negative or adverse <br />impacts. Although some sales of alcoholic beverages will occur within the outdoor <br />patio, the area is only 468 feet in size and is contained by a perimeter fence. <br />• <br />1 <br />
