• Tentative Parcel Map No. 2000-106 is for subdivision purposes only and does not involve any <br />new construction on the site. The proposed lot sizes meet the minimum required size of 25,000 <br />square feet as outlined in the specific development plan. Four of the subject parcels have been <br />previously approved for development. There are no physical constraints on the site to preclude <br />development of the fifth parcel. <br />D. The design and improvements of the proposed project will not cause substantial environmental damage <br />or substantially and avoidably injure fish or wildlife or their habitat. <br />The parcel map will not cause any environmental damage nor injure fish or wildlife as the site <br />is currently occupied by commercial structures. In addition, no fish or wildlife was identified as <br />residing on the project site during the environmental review of this project. <br />E. The design or improvements of the proposed project will not cause serious public health problems. <br />No alterations are proposed to the development project that will lead to serious damage or <br />create public health problems. Prior approvals for this site to allow the construction of a new <br />Home Depot and garden center, Staples office supply and two fast food restaurants have <br />previously been analyzed to ensure that no environmental or health problems would be created. <br />As a result, approval of Tentative Parcel Map No. 2000-106 will not affect the health or safety <br />of persons residing in the vicinity. <br />~. The design or improvements of the proposed project will not conflict with the easements acquired by <br />the public at large for access through or use of property within the proposed project. <br />Approval of the tentative parcel map will not create any conflicts with existing easements found <br />on the site. As a condition of approval of the parcel map, conditions, covenants and restrictions <br />(CC&R's) were reviewed and approved and will be recorded with the final map. These <br />CC&R's will ensure that the appropriate easements such as access, egress, drainage, utility and <br />other necessary easements are maintained over the five parcels. <br />2. Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review <br />No. 01-24 is hereby approved and adopted. <br />Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1), the Zoning <br />Administrator has determined that, after considering the record as a whole, there is no evidence that the <br />proposed project will have the potential for any adverse effect on wildlife resources or the ecological habitat <br />upon which wildlife resources depend. The proposed project exists in an urban environment characterized by <br />paved concrete, roadways, surrounding buildings and human activity. Therefore, pursuant to Fish and Game <br />Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not <br />required in conjunction with this project. <br />3. Tentative Parcel Map No. 2000-106 is hereby recommended for approval, as conditioned in <br />attachment A, attached hereto and incorporated herein. <br />2 <br />
