That the granting of a variance is necessary for the preservation and enjoyment of one or <br />more substantial property rights. <br />The granting of the variance for secondary signage will allow the tenant the ability <br />to identify three departments or services that will be provided within the store. <br />The variances for freestanding signage are not necessary to preserve property rights <br />as the tenant will still be able to install new conforming signs, which provide <br />adequate business identification. <br />C. That the granting of a variance will not be materially detrimental to the public welfare or <br />injurious to surrounding property. <br />The three additional canopy signs will not be detrimental to the surrounding area as <br />a condition of approval has been added that will limit the amount of secondary <br />signage allowed on the site. This will assist in minimizing the visual clutter found <br />on structures with multiple wall signs. <br />The granting of the variances for the freestanding signage may be detrimental to the <br />area by allowing excessively large signage, not enjoyed by other properties, on the <br />• site, which may contribute to adverse aesthetic impacts along the street. <br />D. That the granting of a variance will not adversely affect the General Plan of the City. <br />The granting of the variances will not adversely affect the City's General Plan in any <br />way as the land use designation of General Commercial (GC) allows signage in <br />conjunction with retail uses in the land use designation. <br />2. Variance No. 00-68 is approved in part for relief from Section 41-863(a), as conditioned <br />in attachment "A" attached hereto and incorporated herein, and denied in part as to relief sought <br />from Sections 41-862(b) and 41-862(c)(2), based upon the aforementioned findings. <br />• <br />2 <br />
